Terms of Service

KalQSplit ("KalQSplit," "we," "us") is operated by Mark Agustin as a sole proprietor. These Terms of Service ("Terms") govern your use of KalQSplit at kalqsplit.com (the "Service"). By creating an account, joining a group as a guest, or otherwise using the Service, you agree to these Terms and to our Privacy Policy.

1. Who can use KalQSplit

You must be at least 16 years old to use KalQSplit. By using the Service you confirm you meet this requirement. (Raised from 13 on July 10, 2026, to use one consistent line worldwide rather than vary by country — some places KalQSplit operates in treat 16 as the age a minor can consent to a digital service on their own.) If you create a group or expense on behalf of other people (e.g. adding a guest by name), you're responsible for making sure they're comfortable being added.

2. What KalQSplit is — and isn't

KalQSplit is a bookkeeping and calculation tool for splitting shared expenses. It helps a group track who paid for what and what everyone owes, and lets members record that a payment happened.

KalQSplit never processes, holds, or moves money. All actual payments between members (Venmo, cash, bank transfer, or anything else) happen entirely outside the Service. "Settling up" or confirming a payment notice in the app only updates a ledger entry — it does not send, receive, or custody any funds. KalQSplit is not a money transmitter, payment processor, or financial institution, and balances shown in the app are not a guarantee that any payment was actually made.

3. Accounts and guests

Creating a group or logging an expense requires a registered account (email + password). Anyone else can join a group and participate in expenses as a guest via an invite link, without creating an account. Guests are identified by a browser cookie and by whatever name was entered when they joined — KalQSplit does not verify a guest's identity.

You're responsible for keeping your password confidential and for all activity under your account. Let us know if you believe your account has been compromised.

4. Your content

You're responsible for the accuracy of the expenses, amounts, names, and receipt images you enter. KalQSplit doesn't verify that a logged expense, split, or settlement reflects what actually happened between group members — disputes about who owes what are between the people in the group, not something KalQSplit adjudicates.

If you upload a receipt photo, it may be sent to a third-party AI service to extract line items automatically (see the Privacy Policy for details) — review the pre-filled results before saving, since AI-read amounts can be wrong. Receipt photos are automatically deleted after 90 days on Free groups, or 365 days on Pro/Insider groups (based on the group creator's plan); the expense itself, including its line items and amounts, is kept regardless.

5. Free, Pro, and other tiers

KalQSplit currently offers Free and Pro-style feature tiers. There is no billing wired up yet — no payment is currently collected for any tier, and features/limits described in the app may change as this evolves. If paid billing is introduced in the future, these Terms will be updated first and you'll be told what you're paying for before being charged.

6. Acceptable use

  • Don't use KalQSplit to harass, defraud, or impersonate anyone.
  • Don't attempt to access another user's account or another group's data without authorization.
  • Don't submit unlawful, abusive, or infringing content (including receipt images or feedback submissions).
  • Don't attempt to disrupt, overload, or reverse-engineer the Service.

We may suspend or terminate access for accounts that violate these Terms.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including correctness of any balance, split, or currency conversion it calculates. KalQSplit is a personal/small-scale project under active development — features may change, and data loss, though not expected, is possible.

8. Limitation of liability

To the fullest extent permitted by law, KalQSplit and Mark Agustin will not be liable for any indirect, incidental, special, or consequential damages, or for any amount of money a group member fails to actually pay another member outside the Service. Our total liability for any claim relating to the Service is limited to the amount (if any) you paid us in the twelve months before the claim arose.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. If you keep using the Service after a change, you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, unless a different jurisdiction is required by law where you live.
